Somewhere Between Heaven and Hell, Part 3: Settlement

In Part 1, we covered the gap between what potential damages are and what the defendants could possibly afford to pay, and that insurance is unavailable. In Part 2, we looked at bankruptcy and what that might mean for the industry. Neither are particularly attractive options for anybody.

That means the possibility of a settlement between the plaintiffs in these various lawsuits and the industry is higher than we might think. The question is, how… and what such a settlement might look like.

In this part, we’ll take a look at some of the issues around a settlement before a judgment. Then take a look at some kind of a settlement post-judgment as well.
